Requesting A New I-9 Due To Section 1 Errors

Why do I have to collect a whole new submission of Section 1 and 2 when an error is discovered on Section 1? Can’t I just make an edit to that and not require the employee to complete Section 2 again?

With WorkBright’s I-9, we have carefully crafted field validation around key areas of Section 1 & Section 2 to reduce errors, ensure compliance, and increase throughput. Some of the more simple validations include character counting for fields such as phone numbers and social security numbers. However, some of the more complex validations incorporate key aspects of Sections 1 and 2, which makes it imperative that when making corrections, we receive a new submission.

For example, we have validation to ensure the name of the person submitting and the name of the authorized representative are not the same. So in this instance, if an employee were updating their name (Section 1), we would need to rerun the authorized representative to make sure that the name of the signature (Section 2) did not match. This is a compliance protection for your I-9s.

In addition to validation, there are many compliance aspects that would require a resubmission of Section 2. For example, if they were updating their citizenship status (Section 1), then that would present to them a different set of acceptable documents from List A, B, or C (Section 2), and that information would need to be reverified.

One additional legal factor at play is that the Authorized Representative in Section 2 is certifying that “... (2) the above-listed document appears to be genuine and to relate to the employee named”...” so if the employee is changing information in Section 1 that the Authorized Representative reviewed and signed off on then that would be out of compliance.
