How Do We Handle Insurance Claims and Project Damages?

At WXLLSPACE, we take every precaution to minimize risk across all mural projects. However, in the rare event that damage or injury occurs during the course of a project, we have strict protocols in place to ensure clarity, accountability, and resolution for all parties.

This guide outlines how WXLLSPACE handles insurance claims and project-related damages—including insurance requirements, what is covered, and the step-by-step process if an incident occurs.

Insurance Requirements

WXLLSPACE maintains general liability insurance coverage for all mural installations we directly manage. This insurance is in place to protect against third-party bodily injury or property damage during the active course of work.

Separately, each artist working through WXLLSPACE is required to carry their own valid insurance policy. Before the start of any project, the following must be submitted:

  • A valid Certificate of Insurance (COI) naming both WXLLSPACE and the property owner as additional insured.

  • General Liability Coverage with at least $1M per occurrence / $2M aggregate.

  • Workers’ Compensation and/or an insurance waiver, depending on jurisdiction and the nature of the work.

Failure to submit proof of insurance will result in a delay or cancellation of the project assignment.

Property owners have the right to request a copy of all insurance documents before installation begins.

What Our Policies Cover

WXLLSPACE’s and the artist’s insurance coverage generally apply to:

  • Physical damage to the property during installation (e.g., overspray, scissor lift impact, paint spills).

  • Bodily injury to third parties resulting from the artist’s actions or equipment used on-site.

  • Accidents involving rented or owned lift equipment.

Not covered under default insurance terms:

  • Pre-existing damage to the wall or surrounding property.

  • Vandalism or graffiti that occurs after the mural is complete (unless a protective clear coat has been contractually applied).

  • Environmental or weather-related damage (“Acts of God”) unless directly tied to negligence.

  • Project delays due to artist-related factors, improper planning, or environmental changes after approval.

What to Do If Damage Occurs

If damage occurs during a mural project, the following steps must be completed within 24 hours:

1. Immediate Notification

  • Notify WXLLSPACE immediately by emailing support@wxllspace.com.

  • Provide a written summary describing what happened, who was involved, and when it occurred.

  • Attach supporting documentation such as photos, videos, or incident reports.

2. Internal Review by WXLLSPACE

  • WXLLSPACE will initiate an internal review within 48–72 hours.

  • Our team will collect statements from the artist, the property contact, and any on-site vendors or contractors.

  • We will determine whether the incident falls under WXLLSPACE’s general liability coverage or the artist’s insurance.

3. Insurance Coordination

  • Artists are required to notify and initiate communication with their own insurance provider and include support@wxllspace.com in all correspondence.

  • WXLLSPACE will collect a damage repair estimate or invoice from the property owner or affected party.

  • If the incident stems from artist negligence, lack of care, or subcontractor error, we will redirect the claim to the artist’s insurance policy.

4. Resolution Plan

  • WXLLSPACE will outline a resolution plan, which may include payment for damages, repair coordination, or reimbursement.

  • In some cases, we may deduct the confirmed cost of damage from the artist’s final project payment, particularly if the issue falls outside of insurable coverage and the artist is deemed responsible.

Additional Responsibilities and Considerations

  • Subcontractors: If you intend to work with any subcontractor (e.g., lift operators, assistant painters), they must be disclosed to WXLLSPACE in advance and must carry valid insurance. You are responsible for their conduct and compliance on-site.

  • Clear Coat and Vandalism Protection: If a clear coat is applied, it is intended for UV/weather resistance and, in some cases, anti-graffiti protection. This must be requested and approved in advance as a separate line item. Any vandalism or damage post-install is not automatically covered unless a protection plan was contracted.

  • Failure to Report: Artists who fail to report incidents within 24 hours may be held personally responsible for any costs incurred due to delays or lack of timely information sharing.
