Young Heroes Guardian Consent

I am the parent or legal guardian of the minor child identified in my StartPlaying account (my “Child”), whose date of birth and age I provided during account registration. My Child is between 9 and 17 years old. I have the legal authority to sign on behalf of my Child. As used in this Agreement, “Authorized Individual” means me, as the signing parent or legal guardian, or another adult I have designated in writing to act on my Child’s behalf.

I consent to my Child participating in a virtual tabletop role playing game (the “Session”) that will be conducted through an online video conference platform. The Session will be run by an adult (the “GM”) who has created the campaign for the Session. The GM has been vetted by StartPlaying and passed a background check. During the Session, the GM has my express consent to talk to my Child only as needed to perform the Session. For the sake of clarity, the GM is not permitted to speak with my Child at any time in a manner that would violate StartPlaying’s Terms of Service or Code of Conduct. The GM and my Child may share with each other approved character sheets or other approved items necessary to facilitate the Session. However, neither the GM nor any other StartPlaying employee shall share, distribute, or otherwise provide any other items to my Child without my or another Authorized Individual’s express written consent. Furthermore, neither the GM nor any other StartPlaying employee shall communicate directly with my Child outside of the Session without my or another Authorized Individual’s express written consent.

I have reviewed and agreed to the Terms of Service, Code of Conduct, and Privacy Policy (collectively the “Rules”). I also agree and acknowledge that the Rules apply to my Child. My Child shall also comply with all instructions from GM or any StartPlaying employee during the Session. If my Child violates the Rules or disobeys a direct instruction from the GM or StartPlaying employee, then StartPlaying reserves the right to take the appropriate action.

StartPlaying may monitor the Session to ensure all participants are complying with the Rules and for quality assurance, however, StartPlaying does not have an obligation to actively monitor a Session while it is happening. Therefore, I will supervise my Child during the Session and alert StartPlaying if an issue occurs. StartPlaying may create a record, written or otherwise, of the Session that can be reviewed by StartPlaying for quality assurance purposes and for any alleged violations of the Rules. Any record of the Session shall not be shared with any third party without my express written consent. Records of Sessions involving my Child shall be retained only for as long as necessary for the purposes described above or as required by applicable law, and shall not be used for any other purpose, including training artificial intelligence systems, without my express written consent.

I expressly consent to StartPlaying collecting the personal information of my Child in order to help facilitate the Session and StartPlaying’s services. The personal information collected may include, but is not limited to, my Child’s name, age, and any information shared during the Session. StartPlaying will collect only the minimum personal information necessary to provide its services. Any collection, use, and retention of my Child’s personal information will comply with the Privacy Policy, the Children’s Online Privacy Protection Act (“COPPA”), and all other applicable federal and state laws. I understand that I may, at any time: (a) review the personal information collected from my Child; (b) request that such information be corrected or deleted; and (c) withdraw this consent, which will result in my Child being unable to continue participating in Sessions. My Child’s participation shall not be conditioned on the disclosure of more personal information than is reasonably necessary to participate in a Session.

My Child is physically able to participate in the Session. In the event of a medical emergency, StartPlaying is not liable for any medical emergency and is not obligated to provide any medical assistance. I acknowledge that StartPlaying is an online platform and that any medical emergency during a Session is my sole responsibility as the supervising parent or guardian. StartPlaying reserves the right to immediately cancel or reschedule a Session if a medical emergency occurs either before or during a Session. Nothing in this paragraph shall be construed to waive any rights that my Child may have under applicable law.

This Agreement shall be governed by and construed in accordance with the laws of the state in which StartPlaying is incorporated, without regard to its conflict of law provisions. Any dispute arising out of or relating to this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent harm to a minor child.

StartPlaying will notify me of any material changes to this Agreement, the Rules, or its data practices at least thirty (30) days before such changes take effect, via the email address associated with my account. My continued authorization of my Child’s participation after such notice constitutes acceptance of the updated terms.

By clicking “I Agree,” I confirm that I have read and understood this Agreement, that I am the parent or legal guardian of the Child identified in my account, and that I am providing my verifiable parental consent freely and voluntarily. I understand that clicking “I Agree” constitutes my electronic signature and has the same legal effect as a handwritten signature.
