The EB-5 process comprises of 3 basic stages:
Initiate the EB-5 investment and file the I-526 petition.
After I-526 approval, file the I-485 to adjust status or DS-260 for consular processing. Once approved, the 2-year conditional residence period begins.
File the I-829 petition to remove conditions any time 90 days before the end of the 2-year conditional residence period.
To get started, the EB-5 investor should do the following:
Complete due diligence on a chosen EB-5 project.
Fill out the Investor Questionnaire and verify Accredited Investor status.
Hire an immigration lawyer.
Prepare the source of funds documents.
Execute the subscription documents.
Transfer investment funds and fees to the EB-5 project.
File the the I-526 petition.
