Terms & Conditions Guidelines

Updated over 8 months ago

Terms & Conditions are a set of rules which your users, or students, must abide by in order to access your school or online course and use your products and services. Terms & Conditions help prevent abuse, protect your content, limit liability, and allow you to terminate your students’ accounts or access under certain conditions.

Additionally, your Terms & Conditions guide your students and help them understand what is and is not acceptable. A solid set of terms helps avoid future confusion or conflict.

Creating a simple, clear Terms and Conditions (T&C) document is essential for digital creators and online course creators to protect their content and set expectations with their users.

Here are some tips for drafting your first T&C document:

1. Outline Ownership of Content

  • Specify that all content (videos, materials, PDFs, etc.) provided on your website or in your course is owned by you, the creator.

  • Add that users are granted a limited license to access the content for personal, non-commercial use only.

  • Mention that unauthorised distribution or resale is prohibited.

2. Set Usage Rules and Restrictions

  • Define the acceptable ways for users to interact with your site and content, like prohibiting copying, modifying, or reverse-engineering materials.

  • Clearly state any age requirements (e.g., users must be over 18).

3. Include Payment and Refund Policies

  • Outline payment terms if you’re selling courses or digital products, including pricing, payment methods, and when charges will occur.

  • Clearly specify your refund policy, whether it's a no-refund policy, a limited refund period, or special conditions for refunds. This helps manage expectations and protect against disputes.

4. Describe Liability Limitations

  • Limit your liability by stating that you won’t be responsible for any damages or losses that may arise from using the site or content.

  • Include a disclaimer noting that the information provided is for educational purposes and should not be considered professional advice.

5. Clarify Access Rights and Account Termination

  • Outline conditions under which you may suspend or terminate a user’s account, like policy violations or suspicious activity.

  • Include a clause about your right to modify or discontinue the website or services.

6. Address Intellectual Property Rights

  • State that all intellectual property on the site, including trademarks, graphics, and text, is protected. Include a clause on respecting copyright and not infringing upon your rights.

7. Add a Privacy Policy Reference

  • While not a part of the T&C, it’s helpful to reference your privacy policy and link to it, as this informs users about how their data is handled.

8. Use Clear, Simple Language

  • Avoid overly complex legal jargon. Write in simple, clear language that is easy to understand, which builds trust and ensures transparency with your audience.

9. Seek Legal Review

  • If possible, have a legal professional review your T&C document to ensure it covers all essential bases and complies with applicable laws. This is especially important if you’re handling sensitive data or dealing with international customers.

These guidelines will help you establish basic protections and set expectations for your audience as they engage with your content.
