Choosing the right fertility agreement depends on the specific reproductive process you're pursuing. We offer four different agreements, each tailored to a unique situation. Here’s a breakdown to help you decide which one is right for you:

  1. Surrogacy Agreement: If you are an Intended Parent who is working with a Surrogate to carry your child, you will need a surrogacy agreement. This agreement outlines the roles, rights, and responsibilities of both the Intended Parents and the Surrogate, covering everything from prenatal obligations, to parental rights and obligations, to confidentiality, and reimbursement of surrogacy or pregnancy related expenses.

  2. Ova Donation Agreement: If you are using an ova Donor to help conceive a child, you will need an ova donation agreement. This agreement establishes the terms of the ova donation, including the Donor’s waiver of parental rights and obligations, the parents’ property and parental rights and obligations, the future exchange of information, future contact, confidentiality, and reimbursement of the ova Donor’s expenses.

  3. Sperm Donation Agreement: If you are using a sperm Donor, whether for home insemination, IUI, or IVF, you will need a sperm donation agreement. This agreement establishes the terms of the sperm donation, including the Donor’s waiver of parental rights and obligations, the parents’ property and parental rights and obligations, the future exchange of information, future contact, confidentiality, and reimbursement of the sperm Donor’s expenses.

  4. Embryo Donation Agreement: If you are receiving a donated embryo to achieve pregnancy, you will need an embryo donation agreement. This agreement establishes the terms of the embryo donation, including the Donor’s waiver of parental rights and obligations, the parents’ property and parental rights and obligations, the future exchange of information, future contact, confidentiality, and reimbursement of the embryo Donor’s expenses.

How to Choose:

  • Consider your fertility journey: The agreement you need will depend on the third party reproduction process you're using (surrogacy, ova donation, sperm donation, or embryo donation).

  • Consult with legal and fertility experts: If you’re unsure which agreement best suits your needs, our legal team at Flowerday Fertility Law is here to help guide you through the process and ensure you select the right agreement based on your situation.
