Transferring Listings & Pending Transactions — California

This article outlines the requirements for transferring listings and pending transactions when joining or leaving Radius Agent in California.

TRANSFERRING LISTINGS AND PENDING TRANSACTIONS - California

When Joining Radius Agent

Listing Contracts - Not Pending, Not in Escrow, may be transferred to Radius Agent as long as the former brokerage approves the transfer and provides the following:

  1. MLS transfer form from your MLS/AOR** signed by the former and new broker

  2. CAR form TOL - Transfer of Listing

  3. A new CAR form AD - Disclosure Regarding Real Estate Agency Relationship, showing Radius Agent DRE 02051216

  4. A new CAR form PRBS -Possible Representation of More Than One Buyer or Seller Disclosure and Consent and

**Some Associations do not allow transfers. In those situations, the active listings must be canceled and relisted with Radius Agent.

List-Side Pending Transactions in escrow may be transferred to Radius Agent as long as the former brokerage approves the transfer and provides the following:

  1. CAR form TOL - Transfer of Listing

  2. A new CAR form AD - Disclosure Regarding Real Estate Agency Relationship

  3. A new CAR form PRBS - Possible Representation of More Than One Buyer or Seller Disclosure and Consent and

  4. CAR form AC -Confirmation of Agency Relationships

  5. Copy of the original Listing Agreement

  6. A signed authorization to transfer form from the MLS

Buy-Side Pending Transactions in escrow may be transferred to Radius Agent as long as the former brokerage approves the transfer and provides:

  1. CAR form TOBR - Transfer of Buyer Representation

  2. A new CAR form AD -Disclosure Regarding Real Estate Agency Relationship for Radius Agent

  3. A new CAR form PRBS - Possible Representation of More Than One Buyer or Seller Disclosure and Consent

  4. CAR form AC - Confirmation of Agency Relationships

Buyer Representation and Broker Compensation Agreement - BRBC may be transferred to Radius as long as the former broker approves the transfer and provides the following:

  1. CAR form TOBR - Transfer of Buyer Representation

  2. A new CAR form AD - Disclosure regarding real estate agency relationship

  3. A new CAR for PRBS - Possible representation of more than one buyer or seller disclosure and consent

  4. CAR form AC - Confirmation of Agency relationship

When Leaving Radius Agent

We hope this doesn’t happen, but if you choose to leave Radius Agent and have active listings NOT pending transactions, the above instructions for required documents still apply, and we must have a current Transaction Management System file containing the following

Active Listings:

1. The current listing agreement showing Radius Agent as the brokerage.

2. All current listing documents in Transaction Management System

3. CAR form TOL -Transfer of Listing

4. MLS Transfer Form

5. Pay a $350 Transfer fee upfront

Pending Transactions List Side under contract in Escrow:

We do not release or transfer any transactions under contract in escrow.

If the agent has moved their license away from Radius, then we will need the following:

  1. The entire and complete transaction documents in The Transaction Management System

  2. CAR form ABA - Additional Broker Acknowledgment, showing the new company they joined

  3. W9 form for the new company

  4. Payment will be made to the new company, NOT the agent

  5. If the agent is a broker, he can continue working on the file, as long as he is a Broker Associate - Check DRE

Pending Transactions Buy Side under contract:

We do not release or transfer any transactions under contract in escrow.

If the agent has moved their license away from Radius, then we will need the following:

  1. The entire and complete transaction documents in Transaction Management System

  2. CAR form ABA - Additional Broker Acknowledgment, showing the new company they joined

  3. W9 form for the new company

  4. Payment will be made to the new company, NOT the agent

  5. If the agent is a broker, he can continue working on the file, as long as he is a Broker Associate - Check DRE

New Construction:

We do not release or transfer any transactions under contract in escrow.
