What type of right to work check do I need to do?
You cannot choose the type of check that is done, it will depend on the candidate’s document. It is recommended to understand how they intend to prove their right to work at the point of interview.
What is the difference between a right to work check and an employer’s right to work check?
As standard when we perform BS7858 checks, we confirm that the candidate has eligibility to work in the UK, and verify their identity. This doesn’t create the statutory excuse that you need as an employer that demonstrates that you’ve performed the checks. The employer’s right to work is a way for you to record that you have performed the check in a way that complies with UK law.
Do I have to use Deploi for my right to work checks?
Not at all. We will still include our standard right to work and identity check to ensure you’re compliant with BS7858.
Do I have to see the documents in person too?
If a candidate has a valid UK or Irish passport or share code, you do not need to see their document in person. If they are using any other document, you must see this in person.
Can I request a right to work check on someone I’ve previously cleared?
Yes. Please contact us in this instance.
What if the Yoti recommendation isn’t ‘Pass’?
If the outcome is ‘failed’, you will need to review the document to ensure you’re happy with it. Yoti can occasionally be sensitive and incorrectly mark a document as failed, however if you are not sure you can reject the document and ask the candidate to try again.
If the outcome is ‘processing’, you will need to wait and return shortly. Yoti may have escalated the document for manual review to ensure they’re providing an accurate outcome.
