Government parental leave payments

Parental leave payments from the government are not subject to superannuation guarantee, as they are not ordinary time earnings from the employer.

However, some employers choose to make super contributions during parental leave as a voluntary benefit.

Employee's own parental leave entitlements

Separately from government payments, employees may have entitlements under the National Employment Standards, their employment contract or your organisation's policies.

These include unpaid parental leave (up to 12 months), right to request extended leave, right to return to same or similar position and protection from discrimination.
