Ending a Tenancy

The RRA - Ending a Tenancy feature is launching soon! The below features won't be in your account yet but you can review the RRA help articles to see how it will work.

Street has a clearly defined process for ending tenancies, ensuring you remain compliant with the Renters' Rights Act.

Ending Tenancies Table

The Ending Tenancies tab in the left side panel gives you a breakdown of all tenancies you have marked as ending, with the tenancy address linking directly to the tenancy notice page.

At the top you'll see a summary of notice statuses with 'Active' showing the total number of tenancy notices that haven't yet ended, 'Pending' showing notices that haven't yet been served, and 'Contested' showing notices that have been disputed by the tenant. You can search and filter the table as well as export the data to CSV using the 'Export' button at the top right.

Note - To access the Export to CSV button you will need a role with the permission 'Allow this user to export data from Street' enabled.

How to End a Tenancy

To end a tenancy head to the tenancy page and click the Manage dropdown in the top right, and select End Tenancy.

From here you'll be asked to enter the date the notice was received and whether it was given by the landlord or the tenant. Once submitted, you'll be taken to the Tenancy Notice page where you can work through the process.

Step 1 - Notice Grounds

The first step is to select the relevant notice grounds from the drop down. Street includes all grounds available under the Housing Act 1988, Schedule 2, as amended by the Renters' Rights Act - including mandatory grounds such as rent arrears, anti-social behaviour, and property redevelopment, as well as discretionary grounds.

You can add multiple grounds using Add a Ground. Each ground will display the notice period required. Once you've added your grounds and entered the notice end date and move out date (optional), click Confirm to proceed.

Step 2 - Compliance Check

The next step is the compliance checks, which ensures all required compliance documents are in place before the notice is served. This includes a valid Gas Safety certificate, EICR, EPC (where applicable), the How to Rent Guide, and the deposit protection certificate. If any are expired or missing you can update them here.

Tip! Documents that are not applicable to the property - such as Gas Safety for a property that doesn't require it - will be hidden automatically based on your property settings.

You can also upload any grounds-specific evidence in the Grounds Specific Evidence section. Documents uploaded here are saved against the tenancy notice.

Compliance Bundle

Once the compliance step has been confirmed, you can also generate and download a Compliance Bundle - a ZIP file containing all documents associated with the notice.

Step 3 - Notice Generation

The final step is to generate and serve the notice. If you have served this externally to Street, you can click the 'mark as served' button to choose how (hand delivery, post etc) and when notice was served as well as who served it. Once saved, the notice will move into the status Served.

Alternatively you can use the Form 3 Notice drop down to generate a document using one of your document templates, or upload an external document.

It's important to note that to generate a document in Street you'll need a document template that 'relates to' Tenancy Notice. This can be set up within your Document Template Settings.

Additionally, if you use the Xodo (Eversign) integration and your template includes e-signature merge fields, you'll see the option to sign the document once generated.

Note - E-signatures are available for the agent only. It is not possible to add e-signature fields for tenants.

Once the document is generated (and signed if applicable), or an external copy is uploaded, click Serve by Email to send the notice to both the landlord and tenants.

Clicking it will open the email composer where you can choose the recipient/s and select from any correspondence templates that relate to Tenancy Notice or create your own email from scratch. This email will also automatically include the Form 3 Notice as an attachment.

After sending, the notice will move into the status Served.

Outcome

Once the notice has been served, the Outcome card allows you to manage what happens next. If the tenant disputes the notice, you can mark it as Contested here.

A contested notice will not end automatically when the end date lapses and the notice status will update to 'contested'. Additionally, you'll see a warning to this effect and can choose to cancel the process if needed. If the tenant retracts their contest, the notice returns to Served status.

Move Out

After the notice is served you can create a Move Out record directly from the tenancy notice page. This auto-populates with the dates from the notice and creates the relevant move-out tasks including deposit return and final inspection.
