Creator Agreement Template

Use a creator agreement to record the legal terms behind an accepted offer. Sign it before the creator starts production, receives confidential information, or gets advertising access.

Legal note: This is a general educational template, not legal advice. Creally does not review or approve your legal terms and cannot confirm that they fit your jurisdiction, campaign, worker classification, tax position, or privacy obligations. Ask your legal team to adapt and approve the agreement before use.

Choose the agreement structure

Structure

Use it when

Main document

Short form agreement

You are running a one-off UGC package or sponsored post.

One agreement containing the standard terms and campaign schedule.

Master agreement and order form

You expect repeat work with the same creator.

Standard legal terms signed once, with a short order form for each campaign.

Affiliate addendum

Compensation depends on tracked sales, leads, or codes.

Commission rules, attribution, returns, payout schedule, and termination added to the base agreement.

Do not rely on full usage rights

That phrase does not say what the brand may actually do. List the exact files, channels, organic and paid use, license term, territory, exclusivity, editing rights, sublicensing, and whether the brand may advertise through the creator's account. Rights should start only when the contract says they start, usually after payment.

Do not assume freelance content automatically becomes work made for hire. Use a clear license or assignment drafted for your jurisdiction and approved by counsel.

CREATOR SERVICES AGREEMENT

This Creator Services Agreement is entered into as of [effective date] between [Brand legal name and address] and [Creator legal name or business name and address]. Each may be called a Party and together the Parties.

1 Services and deliverables

Creator will provide the services and deliverables in Schedule 1 and follow the final written brief. No post on Creator's account is required unless Schedule 1 lists a posting deliverable. A change to the brief after production begins is a scope change and may require a new fee or delivery date.

2 Brand inputs and timing

Brand will provide the product, access, approved claims, brand assets, and feedback by the dates in Schedule 1. Creator's deadlines move by the length of any Brand delay unless the Parties agree otherwise in writing.

3 Review and revisions

Brand will review each submission within [number] business days and send one consolidated set of feedback. The fee includes [number] revision round. Additional revisions, reshoots caused by a changed brief, or new deliverables require written approval of the added fee and timeline. Creator will correct a material failure to follow the approved brief without an added fee.

4 Fees and payment

Brand will pay Creator the fee in Schedule 1 within [15 or 30] days after [accepted final delivery / publication / valid invoice]. Brand will reimburse only expenses approved in writing before they are incurred. Creator is responsible for taxes, filings, and charges that apply to Creator's business, except amounts Brand must withhold by law.

5 Content rights

Except for Brand Materials, Creator retains ownership of the Content unless Schedule 1 expressly selects an assignment. After Brand pays all undisputed amounts, Creator grants Brand the license stated in Schedule 1. The license must identify the covered final and raw files, media and accounts, organic and paid use, territory, term and start date, editing rights, exclusivity, and sublicensing.

No allowlisting, Partnership Ads, Spark Ads, creator-handle advertising, or similar account permission is granted unless Schedule 1 names the permission and its duration. Brand will not request Creator's password; access must use the platform's approved authorization method. If the Parties select an assignment, legal counsel should replace this section with jurisdiction-specific assignment language.

6 Name image and likeness

Creator permits Brand to use Creator's approved name, handle, voice, image, and likeness only as they appear in or are needed to distribute the licensed Content, for the same media, territory, and term stated in Schedule 1.

7 Materials and third party rights

Creator will use original or properly licensed music, footage, locations, and appearances and will obtain required releases. Brand is responsible for the accuracy and rights of claims, trademarks, footage, scripts, and other materials it supplies. Neither Party may require the other to use material it does not have the right to use.

8 Disclosures and platform rules

If Creator publishes or endorses the product, Creator will clearly disclose the relationship with Brand, follow the approved disclosure instructions, use required platform tools, and comply with applicable advertising rules. Creator will describe genuine experience and will not make claims outside Brand's approved claims. Brand will not ask Creator to hide the relationship or make an unsupported claim.

9 Confidentiality and embargo

Creator will keep non-public campaign, product, customer, pricing, and access information confidential and will not publish embargoed material before [date and time]. Confidentiality does not cover information that is public without breach, already known without restriction, independently developed, or lawfully received from another source.

10 Exclusivity and conflicts

Creator will follow only the category, named competitors, territory, and dates listed in Schedule 1. If Schedule 1 is blank, no exclusivity applies. Creator will disclose any known commitment that would materially conflict with the campaign.

11 Cancellation and termination

Either Party may terminate for a material breach that is not cured within [number] days after written notice. If Brand cancels for convenience after work begins, Brand will pay for approved work completed, approved non-refundable expenses, and the kill fee in Schedule 1. If Creator cannot complete the work, Creator will return any unearned prepaid fee and any loaned property, subject to applicable law.

12 Performance and relationship

Creator will perform the services professionally but does not guarantee views, conversions, sales, or other campaign results unless Schedule 1 expressly states a guaranteed deliverable. Creator is an independent contractor and has no authority to bind Brand. Nothing in this Agreement creates employment, partnership, or agency between the Parties.

13 General terms

This Agreement and Schedule 1 are the complete agreement about the services and replace prior discussions on the same subject. Changes must be agreed in writing. Electronic signatures and counterparts are permitted. Notices will be sent to [email addresses]. The Agreement is governed by the laws of [jurisdiction], and disputes will be handled in [forum or agreed process]. If a term cannot be enforced, the remaining terms continue.
