How to Add a Break Clause to Your Tenancy Agreement

A break clause is a provision in a tenancy agreement that allows either the landlord or the tenant to end the tenancy earlier than the end of the fixed term, provided certain conditions are met.

A break clause can be useful for both parties in case of unforeseen events or a change in circumstances. It is important that before adding any break clause, you ensure it has been mutually agreed with the Landlord and the Tenant.

Note: If your agency uses a custom agreement (instead of one of the standard agreements provided by Propoly) then your agreement may or may not have a break clause available. Please check your agreement if you are unsure!

If you need to add a break clause to your tenancy agreement, follow these simple steps:

Step 1: Open the Deal

Open the deal you would like to issue the offer letter for. This can be done by clicking on the deal from your dashboard or by searching for it in the search bar.

Step 2: Edit the Deal

Once you have found the deal, you will need to edit the details. To do so, click on the three dots located above the tenancy end date.

This will open a drop down menu. Select "Edit Deal" from the available options.

This will take you to the "Create Deal" screen.

Step 3: Turn on the Break Clause

From the "Create Deal" screen, scroll down until you see a Toggle called "Break Clause" and ensure this is switched to "Yes".

Once you have turned on the break clause toggle, new sections will appear where you can edit the Landlord and the Tenant's break clause respectively. You specify at what point in the agreement each party is allowed to give notice, and how much each party must give. Set these in line with what you have agreed with your Landlord and Tenant.

Note: Remember that all clauses in contracts must be fair to the consumer (in this case, the tenant). It is usual to give both parties equal opportunity to end the tenancy early, however if one party is given more advantageous terms, this should usually be the tenant, to ensure there is no suggestion of unfairness.

Step 5: Save the Changes

After making your changes, click on the "Save Deal" button at the bottom of the page. This will save the changes you have made to the tenancy agreement, including the addition of the break clause.
