What you agree to in working an EB3 job

When you receive work authorization, you will need to confirm the following terms and conditions before starting work. Everyone will receive this in a private message from the Client Services Team, but we want to post it publicly so everyone is aware.

  1. You agree that you will have conversational-level English by the time you start working for your sponsoring employer. The employer may refuse to hire you if you are unable to communicate in English.

  2. You agree to start work for the sponsoring employer as soon as possible (target: 60 days from work authorization).

  3. You agree to work full-time (generally 40 hours per week) for the sponsoring employer for at least 12 consecutive months (12 months in a row).

  4. You agree not to move to your work area or secure permanent housing until we have a worksite secured for you.

  5. You are aware that your Worksite may change from the original address on your LC. See this article to know more.

  6. You agree to work at any worksite (within your MSA) provided to you according to the sponsor's staffing needs.

  7. You are willing and able to work any shifts for your sponsoring employer, including weekend, day, or night shifts. You can be fired if you refuse to work your assigned shifts.

  8. You will raise any unexpected scheduling concerns or substantial difficulties (such as health issues) with BDV’s Client Services Team. We may help you make a request to the sponsoring employer in limited circumstances, but your sponsoring employer has the right to deny the request.

  9. You must prioritize your work with your sponsoring employer over attending school.

  10. You must prioritize your work with your sponsoring employer over working a second job.

  11. You will notify BDV within 1 week of receiving your work authorization, renewal, and/or green card.

  12. If you do not work for your sponsor, are terminated, or leave your job before 12 months, your I-140 may be withdrawn by your sponsor.

These terms and conditions were included in the contract you previously signed with BDV, and following them will help you be successful in your EB3 job!
