Terms and Conditions

These Terms and Conditions (the “Terms”) govern your use of the Chexy Mortgage Payments service that allows you to make residential mortgage payments and earn Aeroplan points (the “Service”). The Service is operated by Chexy Inc. (“Chexy”, “we”, “us” or “our”). These Terms are in addition to Chexy’s Terms of Use (chexy.co/T&Cs) and Privacy Policy (chexy.co/privacy-policy), each incorporated by reference. Capitalized terms not defined here have the meaning given in the Terms of Use.

These Terms are in addition to, and do not replace, the Aeroplan Program Terms and Conditions established by Air Canada (available at aircanada.com/aeroplan). Aeroplan points earned through the Service are subject to those program terms, which Air Canada may amend at any time.

1. Definitions

“Aeroplan” the Aeroplan loyalty program owned and operated by Air Canada.

“Aeroplan Member / Member” an individual who holds a valid Aeroplan membership and Aeroplan Account in good standing.

“Aeroplan Account” a Member’s account under the Aeroplan program.

“Aeroplan Number” the unique account number assigned to an Aeroplan Member.

“Aeroplan Points / Points” the loyalty currency issued under the Aeroplan program.

“Chexy Wallet” the record of funds collected from you and held, pending remittance, in Chexy’s trust account maintained with Peoples Trust Company, from which Chexy remits the Payment Amount to your Eligible Lender.

“Eligible Lender” any lender or servicer of a residential mortgage in Canada. All Canadian residential mortgage lenders qualify for the Service.

“Funding Method” the method you authorize Chexy to use to collect funds from you, being either (a) an eligible Visa Debit or Debit Mastercard card, or (b) a pre-authorized debit from your Canadian deposit account, as described in Section 5.

“Mortgage Payment” a regularly scheduled or lump-sum payment owing by you under your residential mortgage to an Eligible Lender, which you instruct Chexy to remit on your behalf.

“Payment Amount” the amount of your Mortgage Payment that Chexy remits to your Eligible Lender, exclusive of the Service Fee.

“Service Fee” the fee Chexy charges you for the payment service. The standard Service Fee is 1.75% of the Payment Amount. Chexy Plus members may also qualify for a lower Service Fee; Chexy Plus pricing is subject to change at any time. Service Fees are otherwise subject to change, and the applicable Service Fee is disclosed to you before you confirm each Mortgage Payment.

“Transaction” a single instance of you making a Mortgage Payment through the Service.

“You / your” the individual who enrolls in and uses the Service.

2. Eligibility

To enrol in and use the Service, you must:

  • be an individual resident of Canada who has reached the age of majority in your province or territory of residence;

  • be a current Aeroplan Member with an Aeroplan Account in good standing, and add a valid Aeroplan Number to your Chexy account;

  • be a borrower (or otherwise authorized to make payments) under a residential mortgage held with an Eligible Lender;

  • hold a valid Funding Method; and

  • complete Chexy’s account set-up and identity verification requirements.

Your Chexy account must be registered in the same name as your Aeroplan Account, and only one Aeroplan Number may be associated with a Chexy account at a time. We may decline, suspend or terminate enrolment at our discretion, including for fraud prevention, legal or regulatory compliance, or network or partner rules.

3. Nature of the Service; Chexy Acts as Principal

Chexy provides the Service to you as principal, in its own name and for its own account. Chexy does not act as your agent, or as agent of your Eligible Lender or of Air Canada, in providing the Service.

Chexy controls the payment service before it is provided to you: it receives your funds into the Chexy Wallet, determines the manner in which the Payment Amount is remitted, and is primarily responsible to you for delivering the payment service.

Chexy sets the Service Fee at its own discretion and bears the risks of providing the Service, including the risk of payment failure, return, reversal, chargeback and fraud.

The Aeroplan Points you earn are a promotional benefit that Chexy funds and provides to you. Chexy purchases these Points from Air Canada at its own cost and risk and provides them to you as an incentive to use, and continue using, the Service. The Service Fee is the price for the payment service; it is not a payment for Points, and it is not reduced, rebated or offset by the Points you earn. You pay the same Service Fee whether or not Points are credited to your Aeroplan Account.

For clarity, Chexy is not a mortgage lender, mortgage broker, financial advisor or party to your mortgage, and does not provide lending, credit, tax or financial advice. The Payment Amount is funds passing through Chexy to your Eligible Lender and is not Chexy’s property or revenue.

4. How Payments Work

When you confirm a Mortgage Payment, Chexy collects the Payment Amount plus the Service Fee from your Funding Method into the Chexy Wallet, and then remits the Payment Amount to your Eligible Lender using the lender’s accepted channel (for example, pre-authorized debit or bill payment). If your Eligible Lender does not accept a payment channel that Chexy supports, Chexy may be unable to complete the Mortgage Payment.

Funds you provide are received into Chexy’s trust account maintained with Peoples Trust Company. Peoples Trust Company acts as the pre-authorized debit processor for the Service.

You are solely responsible for ensuring your Mortgage Payment details are accurate, scheduled correctly, and made on time. Chexy is not responsible for late fees, interest, penalties or other consequences arising from incorrect details you provide, insufficient funds, or your Eligible Lender’s processing of a payment.

Processing times depend on your Funding Method and Eligible Lender. Processing times depend on your Funding Method and Eligible Lender. Remittance of the Payment Amount to your Eligible Lender typically occurs on your scheduled payment date. However, in certain circumstances, (including weekends, statutory holidays, the processing times of your financial institution or Eligible Lender, or a payment failure, return or review under these Terms) remittance may take up to seven (7) business days from the date Chexy collects funds from your Funding Method.

Chexy does not impose a minimum or maximum Mortgage Payment amount. Funding may, however, be subject to limits set by your card issuer or financial institution (for example, daily debit-card limits).

You may schedule recurring Mortgage Payments and are responsible for cancelling or amending a scheduled payment before it is processed.

5. Funding Methods

Debit card. You may fund a Mortgage Payment using an eligible Visa Debit or Debit Mastercard card. You authorize Chexy to charge your card for the Payment Amount plus the Service Fee. Your card issuer’s limits and terms apply.

Pre-authorized debit (deposit account). If you fund from your Canadian deposit account, you provide a pre-authorized debit (PAD) authorization permitting Chexy and its PAD processor, Peoples Trust Company, to debit your account for the Payment Amount plus the Service Fee. This is a personal PAD under Payments Canada Rule H1. You confirm that all persons required to authorize debits on the account have agreed.

Variable amounts; waiver of pre-notification. Your Mortgage Payment may change over time (for example, after a mortgage rate change), and you agree that the amount Chexy debits under your PAD may vary accordingly. To the extent permitted by Payments Canada Rule H1, you waive the advance (pre-notification) notice of the amount and date of each variable debit that would otherwise be required (generally at least 10 calendar days). You may revoke this waiver or cancel your PAD authorization at any time on notice to Chexy.

Tolerance and true-up. Where the amount owing to the same recipient changes by $500 or less from your previous payment, you authorize Chexy to automatically charge or refund the difference to or from your Chexy Wallet and to process the payment without further notice. Where the amount changes by more than $500, Chexy will contact you to confirm and will not process the changed amount without your confirmation. Chexy provides a confirmation of each debit. You’ll have the ability to customize this threshold in the app.

You may have certain reimbursement and cancellation rights if a debit is not consistent with your PAD authorization. More information is available from your financial institution or at payments.ca. You must maintain sufficient funds and a valid Funding Method and keep your details current.

6. Earning Aeroplan Points

For each completed Mortgage Payment, you earn one (1) Aeroplan Point for every one Canadian dollar ($1.00) of the Payment Amount (the amount remitted to your Eligible Lender, excluding the Service Fee). Points are calculated per Transaction and rounded down to the nearest whole Point.

There is no cap on the number of Aeroplan Points you may earn through the Service.

A Mortgage Payment is completed once it has been successfully processed and delivered through bill payment or Interac e-Transfer, or withdrawn and settled through pre-authorized debit. Points are earned when a payment is completed and will generally appear in your Aeroplan Account within approximately 60 days.

Aeroplan Points provided through the Service are funded by Chexy and purchased by Chexy from Air Canada. Points are not issued by Chexy itself and, once credited, are governed solely by the Aeroplan Program Terms and Conditions.

Points are earned only on Mortgage Payments that remain valid, completed and not reversed. If a payment is later cancelled, reversed, refunded, disputed or returned, or is returned due to insufficient funds, payment failure or chargeback, no Points are earned and Chexy reserves the right to remove the associated Points from your Aeroplan Account.

Aeroplan Points have no cash value, are non-transferable except as permitted by the Aeroplan Program Terms and Conditions, and are not redeemable for cash. Air Canada is responsible for the Aeroplan program and may change, suspend or terminate it, or change the value, availability or terms of Points, at any time.

7. Adjustments, Errors and Discrepancies

Chexy reserves the right to add, remove or correct Aeroplan Points issued in error.

If you believe there is a discrepancy relating to Aeroplan Points earned through Chexy, contact Chexy Customer Support at intercom.help/chexy/en. You must notify Chexy within twelve (12) months of the relevant Transaction.

8. Your Responsibilities and Prohibited Use

You agree that you will not use the Service to:

  • make payments that are not bona fide residential mortgage payments owing by you to a third-party Eligible Lender;

  • engage in money laundering, terrorist financing, fraud or any unlawful activity;

  • make payments where the payer and recipient are effectively the same person or entity;

  • create multiple Chexy accounts, or otherwise artificially generate or inflate Aeroplan Points; or

  • violate the Aeroplan Program Terms and Conditions, applicable network rules, or any applicable law.

We may withhold or reverse Points, suspend or close your account, and refuse to process payments where we reasonably suspect ineligible, abusive or unlawful use, or as required by law or our partners. Chexy complies with applicable anti-money laundering and sanctions laws, including as a registered money services business.

9. Privacy and Information Sharing

We collect, use and disclose your personal information in accordance with our Privacy Policy and applicable privacy laws.

To credit Points and operate the Service, we share certain information with Air Canada / Aeroplan, including your Aeroplan Number and the Points to be credited.

We may share information with our payment processors, your Eligible Lender, and service providers as needed to provide the Service and comply with law.

10. Disclaimers and Limitation of Liability

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Chexy disclaims all warranties, express or implied.

Chexy is not responsible for the acts or omissions of your Eligible Lender, your financial institution, the card networks, or Air Canada / Aeroplan, including any delay, error, change to or termination of the Aeroplan program or Points.

To the maximum extent permitted by law, Chexy is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost Aeroplan Points, lost rewards value or lost profits. To the maximum extent permitted by law, Chexy’s total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the total Service Fees you paid to Chexy for the Service in the twelve (12) months before the event giving rise to the claim, and (b) CAD $500.

Nothing in these Terms limits liability that cannot be limited under applicable law. The limitations and exclusions in this Section do not exclude or limit liability for fraud, gross negligence or wilful misconduct, or, for residents of Quebec, liability for bodily or moral injury or for an intentional or gross fault. The indemnities and dispute-resolution provisions of Chexy’s Terms of Use also apply to the Service and are incorporated by reference, subject to Section 12.

11. Aeroplan Program; Trademarks

Aeroplan and the Aeroplan program are owned and operated by Air Canada. Air Canada is not the provider of the Service and is not responsible for the Service. Your participation in the Aeroplan program is governed by the Aeroplan Program Terms and Conditions.

Aeroplan® and related names and logos are trademarks of Air Canada (or its affiliates), used by Chexy under licence.

12. Changes, Termination and General

Amendments. We may amend these Terms, the Service Fee, the Points earn rate and any limits. We will provide notice of material changes as required by law, and the amended Terms apply to Mortgage Payments processed after the amendment takes effect. If you are a resident of Quebec, we will give you at least 30 days’ prior written notice of an amendment, setting out the new and former wording, the effective date, and your right to refuse the change and terminate the Service at no cost where the amendment increases your obligations or reduces ours; and we will not unilaterally change an essential element of these Terms (such as the Service Fee for a Mortgage Payment you have already scheduled).

Termination. We or you may terminate participation in the Service at any time, including if you violate these Terms. Termination does not affect Points already validly credited or obligations accrued before termination.

Governing law. Except where applicable law provides otherwise, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and the governing-law and dispute-resolution provisions of the Terms of Use apply.

Quebec residents. If you are a resident of Quebec: these Terms are governed by the laws of Quebec; you may bring proceedings before the courts of Quebec; nothing in these Terms or the Terms of Use requires you to submit to arbitration or waives your right to participate in a class action; and any limitation of liability is subject to Section 10.

Language. A French-language version of these Terms is made available to you. Les présentes conditions sont également disponibles en français.

General. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. Participation in the Service constitutes acceptance of these Terms and the Aeroplan Program Terms and Conditions.

By enrolling in or using the Service, you acknowledge that you have read, understood and agree to these Terms.
