What are the terms of employment?

When working through Temper Staff, you’re employed by Temper. Understanding the terms of employment is essential. Here are the key points:

Contract for every shift

When you apply for your first shift, you sign a framework agreement (’raamovereenkomst’) with Temper. For every shift afterward, a labour agreement is automatically generated based on this framework agreement, using your existing signature. Read more about the framework agreement in this article.

Type of contract

As a temporary worker (’uitzendkracht’) for Temper Staff, you have a separate labour agreement for each accepted shift. These are phase A (1+2) contracts with an ‘uitzendbeding’, or temporary worker clause, allowing multiple contracts throughout the year. You are paid only for the hours you work. Compliance with regulations

The automatically generated labour agreements comply with Dutch regulations and relevant CAOs (collective labour agreements), ensuring fair treatment and adherence to minimum wages. Previous work experience does not affect the hourly wage. For the CAO for the hospitality industry (’horeca’), all workers are considered skilled. Surcharges

When working on irregular hours, such as weekends, nights, holidays, or overtime, surcharges apply. This means you will earn more. Read more about these surcharges here. You are also entitled to a travel allowance, and you will accrue pension benefits.

Wage & holidays

Your wage consists of the basic wage plus additional components such as holiday pay and holiday allowance, which are already included in your wage. Read here how your wage is structured.

Cancellation

A company may cancel a shift without consequence if they do so at least 48 hours in advance. If they cancel within 48 hours, you will receive full pay for the shift. If you cancel more than 48 hours in advance, there is no consequence. However, if you cancel less than 48 hours before the shift, it will be marked as a no-show, making your profile less attractive. Strike system

Unwarranted late cancellations, no-shows or significant complaints from companies may result in strikes. Getting 3 strikes will lead to being blocked for Temper Staff shifts. Read more about the strike system here.
